Terms of Service
1. no orders will be accepted that contain criminal content, Gore, explicitly NSFW /sexualized, or that are based entirely on any art that is not legally in your possession or authored by you, with the exception of fanart.
2. the following are forbiden : plagiarism, reproduction or editing of works without prior authorization. The trademark and/or signature must not be erased. The works must not be used commercially when intended solely for personal use, including resale, printing on products, attracting own customers or any means of personal advertising for profit.
• Violations of the aforementioned cases entitle the artist to seek redress for copyright damage, as stipulated in art. 148 of the Brazilian Penal Code.
3. the initial description of the commissioned artwork, as presented in the link to the 01/11/2021 post on the facebook page, accurately reflects the final product, including lines, coloring, details and the artist's specific style.
4. Briefings for orders must be sent by email, including details and references, both in text and images. The artist undertakes to work exclusively on the details specified by the client in the briefing, and is exempt from responsibility for elements not mentioned. Modifications that alter the initial idea of the brief will be subject to an additional hourly fee, according to the time dedicated to the changes.
5. the contractor is responsible for actively monitoring the creative process and responding promptly to any queries from the contracted artist. Failure to respond in a timely manner will result in the project being put on hold and only resumed once a response has been received.
6. the delivery time will be determined according to the style and complexity of the commissioned artwork.
7. payment is required in advance. If the delivery of the artwork exceeds the stipulated deadline and the contractor chooses not to extend the deadline after unforeseen circumstances, two options are offered:
8. if the customer withdraws during the contract, within the stipulated period, they will have to choose between options 1 and 2 mentioned above, plus a fine of 10% of the amount initially agreed.
9. orders not mentioned in the price list and those intended for commercial use are acceptable and subject to negotiation. It is requested that such requests be explicitly mentioned in the contact email for proper discussion.
• Additional modifications will result in delivery of the final artwork only after payment of the corresponding fees.
• Option 1: Partial refund, taking into account the percentage of the artwork completed, and delivery of the artwork as is.
• Option 2: Full refund, with no right to the artwork made so far, including the use of prints and ideas provided by the contractor during the creative process.
Note: I use a translator to communicate, please do not use abbreviations and slang in conversations to facilitate my understanding.
